Determine whether official inspections are required for gas service lines to your household.


Regarding your request for an opinion on the performance of official inspections of gas service connections pursuant to Decree of the Ministry of Labor, Social Affairs and Family of the Slovak Republic No. 508/2009 Coll., which stipulates details for ensuring safety and health protection at work with pressure, lifting, electrical, and gas technical equipment, and which designates technical equipment considered reserved technical equipment, and regarding the re-evaluation of the Ministry of Labor, Social Affairs and Family of the Slovak Republic’s opinion on this issue from May 20, 2010, we state the following:

According to Annex No. 1, Part IV. to Decree No. 508/2009 Coll., gas distribution is classified as reserved gas technical equipment group A, letter g) and group B, letter g). Official inspections of gas distribution A, letter g) and group B, letter g) – only for gas pipelines made of non-metallic materials – are performed according to Annex No. 9 to Decree No. 508/2009 Coll.

The text of the letter from May 20, 2010, regarding question No. 1, “If only the service connection is put into operation, an official inspection is not required,” refers to the gas pipeline to a family house, i.e., from the point of handover to the appliance connection point (from the gas meter box to the appliance) in the family house. An official inspection is not performed on such a gas pipeline because Act No. 124/2006 Coll. on occupational safety and health and on the amendment and supplementation of certain laws, as amended, does not apply to family houses.

Placing Electrotechnical Products with Voltage Above 1000 V AC and Above 1500 V DC on the Market

For such products, the requirements of Act No. 124/2006 Coll. on Occupational Safety and Health must be applied.


According to European legal regulations governing the free movement of products, electrotechnical products with alternating voltage above 1000 V and direct voltage above 1500 V do not have specified details regarding:

  • the placing on the market of individual groups of designated products, depending on their technical complexity and the degree of potential danger associated with their use,
  • the procedures and actions that must be fulfilled during conformity assessment (hereinafter referred to as “conformity assessment procedure”), by specifying or combining them,
  • the content of the relevant documentation depending on the groups of designated products, their technical complexity, the degree of potential threat to legitimate interest, and the method of conformity assessment,
  • the content of the declaration of conformity depending on the conformity assessment procedure used.

For such products, the requirements of Act No. 124/2006 Coll. on Occupational Safety and Health must be applied:

  1. Based on Section 4 of the aforementioned Act, measures must be implemented in pre-production so that the products comply with the requirements arising from regulations to ensure occupational safety and health. Projects, designs of machinery or other technical equipment, and work procedures must include an evaluation of irreducible hazards and irreducible risks arising from the proposed solutions under specified operating and user conditions, a risk assessment during their use, and a proposal of protective measures against these hazards and risks. Since these devices are reserved electrical technical equipment, it is necessary, according to Section 5, Paragraph 3 of Decree No. 508/2009 Coll., to assess such technical documentation in accordance with Act No. 124/2006 Coll. by an authorized legal entity, which will issue an expert opinion on the documentation. Technická inšpekcia, a.s. is an authorized legal entity – registration number OPO-000001-06. The content of the technical documentation submitted for approval must meet the requirements of Annex No. 2 of Decree No. 508/2009 Coll.
  2. Based on Section 5, Paragraph 1 of Government Regulation No. 392/2006 Coll., and given that the safety of such equipment depends on its installation conditions, the employer is obliged to ensure an inspection is carried out after its installation and before its first use, and based on Section 9 of Act No. 124/2006 Coll., within the scope of control activities, to ensure regular inspections of such reserved technical equipment within specified deadlines. Based on Section 12 of Decree No. 508/2009 Coll., these are official examinations and repeated official examinations, which, in accordance with Section 14 of Act No. 124/2006 Coll., are performed by an authorized legal entity. Based on Section 13 of the aforementioned Decree, these are expert inspections and expert examinations. Based on Section 15 of Act No. 124/2006 Coll., the employer may perform expert inspections, expert examinations, and repairs of such equipment based on authorization issued by an authorized legal entity. Technická inšpekcia, a.s., as an authorized legal entity, verifies whether the applicant meets the requirements for the scope of professional competence (type of activity, group, and class) and issues the authorization.
  3. The content of the accompanying technical documentation submitted during these product tests must include:
  • data concerning the identification of the manufacturer or supplier, basic information about the equipment at least to the extent of Annex No. 4 of the decree, and characteristics of the environment in which the equipment can operate. As part of the identification of the manufacturer or supplier, authorizations for activity may also be submitted during the test as follows:
    • for the official examination according to Section 12 of Decree No. 508/2009 Coll., submission of authorization for the installation of electrical equipment in the relevant scope from the entity that performed the installation of the equipment in question
    • for the repeated official examination according to Section 12 of Decree No. 508/2009 Coll., submission of authorization for repairs and maintenance of electrical equipment in the relevant scope from the entity that performs maintenance and any repairs of the equipment in question, if possible, also authorization for the installation of electrical equipment in the relevant scope from the entity that performed the installation of the equipment in question
    • for the type examination according to Section 10 of Decree No. 508/2009 Coll. or for the individual examination of such a product at the manufacturer’s premises, submission of the manufacturer’s authorization for the production of the respective product.
  • operating instructions or references to regulations containing:
    • permissible methods of use,
    • manual for operation, maintenance, inspections, and tests,
    • list of requirements for maintaining operational documentation and records.
    • requirements for the professional competence of persons performing operation, maintenance, inspections, and tests,
    • instructions for installation, testing, and conditions for putting the equipment into operation,
    • list of spare parts and accessories,
  • acceptance documents containing:
    • passport, revision book, or other technical equipment document to the extent determined by safety-technical requirements and the requirements of relevant applicable standards,
    • certification of documentation, if issued,
    • manufacturer’s declaration of conformity of the technical equipment with safety-technical requirements issued based on performed tests prescribed by the relevant standards, or test protocols,
    • certificate of type examination of the equipment,
    • certificate of the first examination and repeated official examination or of an examination performed by a test technician or expert worker,
    • attestations, certificates, descriptions of exceptions, and others.

Methods for Increasing the Safety of Existing Elevators

The article discusses ways to increase the safety of existing elevators, as well as the main differences between elevator modernization and reconstruction.


Methods for Increasing the Safety of Existing Elevators and Identification of Hazards During Repair, Maintenance, Modernization, Reconstruction, and Complete Replacement


Existing elevators, especially those installed before the Lift Directive 95/16/EC came into effect in the Slovak Republic (i.e., July 1, 1999), can cause dangerous situations, as the safety level of these elevators is much lower compared to elevators designed and installed according to the latest standards. Currently, Lift Directive 95/16/EC is no longer valid (it was repealed on April 19, 2016) and was replaced by the new Lift Directive 2014/33/EU. In terms of essential health and safety requirements, there has been no significant change when comparing the requirements of both directives. However, several new harmonized standards for elevators have been adopted, the fulfillment of which ensures compliance with the requirements of the Lift Directive. New elevator standards place increasing emphasis on the safety of both passengers and service personnel.

Developments in elevator safety cannot be stopped. Figure 1 below interprets the gradual development in the field of elevator safety. It is clear that the issue of the safety of existing elevators should be addressed by national authorities, which should establish uniform rules for increasing the safety of existing elevators within the country. This is because the Lift Directive 2014/33/EU prescribes essential health and safety requirements for new elevators and not for existing ones.

The only European regulation addressing the safety of existing elevators is Commission Recommendation 95/216/EC of June 8, 1995, concerning the improvement of safety of existing lifts. In addition to this regulation, there is also the European standard EN 81-80, which sets rules for increasing safety in existing elevators intended for the transport of persons or persons and goods. According to this standard, Technická inšpekcia, a.s. performs, upon request, an analysis of the technical condition of existing elevators in terms of potential dangerous situations, evaluating which parts of the elevator pose the greatest potential danger to passengers.

Despite the mentioned documents, there is no valid legal regulation in the Slovak Republic that establishes rules regarding the increase of safety of existing elevators. Each state should identify the weakest points in the safety of existing elevators and adopt appropriate legislation to eliminate them.

To make an existing elevator safer and meet new requirements, there are practically the following three options:

  • gradual modernization of the elevator,
  • reconstruction of the elevator,
  • complete replacement of the entire elevator.

It is very important to distinguish which option is involved, because during modernization, a repeated official test in the sense of Decree No. 508/2009 Coll. does not have to be performed. This no longer applies to the reconstruction of an elevator, where, on the contrary, a repeated official test must be performed in the sense of Section 9, Paragraph 2, Letter c) of Decree No. 508/2009 Coll. In the case of a complete replacement of the entire elevator, a conformity assessment is carried out according to the currently valid Lift Directive 2014/33/EU and the latest standards.

In practice, it is common for reconstruction to be confused with modernization. Technická inšpekcia, a.s. has issued internal safety and technical requirements for the modernization and reconstruction of elevators that are permanent parts of buildings and structures. These requirements provide practical guidance for a uniform solution for reconstructions, changes, and modifications of the mentioned elevators. The requirements are based on the Austrian standard ÖNORM B2454: 1994, which was translated and partially adapted based on local conditions.

According to the above documents, the following are considered reconstruction:

  1. increase in load capacity,
  2. increase in rated speed,
  3. increase in travel height,
  4. increase in the number of stops, loading points, or landings (without increasing travel height),
  5. change in the type or dimensions of landing doors,
  6. change in the intended use,
  7. installation of additional electrical safety devices and other elements in the safety circuit and/or installation of additional hydraulic safety devices,
  8. simultaneous implementation of 4 changes (replacements) of a modernization nature.

The following are considered modernization:

  1. change in the position of the counterweight or balancing weight track,
  2. relocation of the machine room,
  3. change of entrances and dimensions of the machine room and/or pulley space,
  4. additional installation of car doors,
  5. replacement of buffers,
  6. replacement of landing door interlocks,
  7. replacement of safety gears,
  8. replacement of the overspeed governor,
  9. replacement of the elevator machine,
  10. replacement of suspension means,
  11. replacement of electrical safety devices and other elements in the safety circuit and/or replacement of hydraulic safety devices,
  12. installation of emergency signaling,
  13. change of control system,
  14. change of power supply and/or control of the elevator machine drive regulation,
  15. replacement of the control panel,
  16. replacement of electrical installation (without replacement of the control panel and electrical safety devices and other elements in the safety circuit),
  17. replacement of car guide rails,
  18. replacement of the car,
  19. replacement of the shaft enclosure.

When performing modernization or reconstruction work, during complete replacement of the entire elevator, or during repair and maintenance work on the elevator, several risks are present. Figure 2 below provides a basic overview of the hazards that occur during the above activities in the elevator machine room, in the shaft, and in the pit.

Figure 2 clearly shows that elevator technicians are exposed to several risks that need to be eliminated or reduced to an acceptable level. Some risks can be eliminated or reduced using collective measures; however, in many cases, it involves individual protection in the form of personal protective equipment (PPE). Figure 3 describes the basic PPE used by elevator technicians during specific activities on the elevator. The selection of suitable PPE depends on the activity being performed and the hazards involved.

Despite the increasing safety of elevators, accidents, including fatal ones, still occur today during elevator operation. There is also an increasing emphasis on the safety of procedures when performing specific activities on elevators by elevator technicians. However, we also currently encounter serious injuries during elevator service work. It is necessary to realize that with the development of elevators, new risks also arise, from which elevator technicians must protect themselves in an appropriate manner. The Deming cycle of continuous improvement should also be applied in this area.

In general, it is necessary to realize that an elevator is a technical device which, if it does not meet safety requirements, can create dangerous situations and cause injury to passengers as well as elevator technicians. It should be taken into account that an elevator intended for the transport of persons and goods is considered classified lifting technical equipment, for which special rules are established for its design, construction, manufacture, assembly/disassembly, reconstruction, operation, maintenance, repair, and testing. If regular inspections and adequate maintenance are not performed on the elevator, and identified deficiencies from inspections are not corrected, the continuous safe operation of the elevator cannot be ensured.

Safety of Escalators and Moving Walkways

This article explains the basic safety principles for escalators and moving walkways, considering regulations and the risks affecting passengers.


Safety of Escalators and Moving Walkways


Escalators and moving walkways are lifting devices used for transporting people between different height levels, offering the highest transport capacity compared to other lifting devices. The operating principle of escalators and moving walkways involves a motor-driven chain of interconnected steps, belts, or pallets that cyclically move along a fixed path. Practically, it is a chain conveyor, similar to those designed for cargo transport in manufacturing plants. In most cases, they are installed in locations where installing elevators would be impractical. They are most commonly found in airports, subways, large department stores, major transportation hubs, and similar venues.

Currently manufactured and installed escalators and moving walkways must comply with numerous safety regulations – applicable requirements from Annex I of European Parliament and Council Directive No. 2006/42/EC on machinery, and the requirements of standards for escalators and moving walkways. Despite strict requirements, escalators and moving walkways are among the lifting devices that account for a high number of accidents across Europe.

For a better understanding of the terminology related to escalators and moving walkways, Figure 1 illustrates the basic parts of an escalator.

Technical Regulations Applicable to Escalators and Moving Walkways

As mentioned above, escalators and moving walkways must currently meet at least the requirements specified in Annex I of European Parliament and Council Directive No. 2006/42/EC on machinery, which was transposed into Slovak legislation as Government Regulation of the Slovak Republic No. 436/2008 Coll. Older escalators and moving walkways within the European Union had to comply with Council Directive No. 93/44/EEC, which supplemented the first Machinery Directive No. 89/392/EEC. The subsequent issue of the Machinery Directive No. 98/37/EC was already transposed by the Slovak Republic through Government Regulation of the Slovak Republic No. 391/1999 Coll. Before the adoption of this regulation, escalators and moving walkways in the Slovak Republic were manufactured, installed, and put into operation solely based on valid Slovak Technical Standards (STN).

Below is an overview of the standards used for escalators and moving walkways, chronologically ordered by publication date. This year, the latest standard STN EN 115-1:2018 – Safety of escalators and moving walkways. Part 1: Construction and installation, was published, which applies to new escalators and moving walkways. This standard contains several significant changes compared to the original standard STN EN 115-1+A1:2010. The biggest changes concern functional safety, control and safety circuits, as well as the reliability of the entire system.

For existing escalators and moving walkways, the best option is to use standard STN EN 115-2:2010, which establishes rules for improving the safety of existing escalators and moving walkways. This standard can be used to perform an analysis of the technical condition of existing escalators and moving walkways, the result of which identifies parts of these devices designated for replacement or modification to reduce existing risks.

Standards related to escalators and moving walkways include:

Safety Level of Escalators and Moving Walkways

The safety of escalators and moving walkways is a frequently discussed topic across Europe. Existing escalators and moving walkways in the Slovak Republic can be divided into three basic groups: the first group consists of escalators and moving walkways that were designed and manufactured according to Slovak standards before the effectiveness of Government Regulation (NV) of the Slovak Republic No. 391/1999 Coll. The second group includes escalators and moving walkways designed and manufactured in accordance with European Directive 98/37/EC (transposed in the Slovak Republic into NV SR No. 391/1999 Coll.), which began to apply in the Slovak Republic from January 1, 2000, when the Slovak Republic adopted EU legislation and European standards. In 2004, NV SR No. 391/1999 Coll. was replaced by NV SR No. 310/2004 Coll., which also transposed the aforementioned Directive 98/37/EC, among other regulations. Escalators and moving walkways designed and manufactured according to Machinery Directive 2006/42/EC (transposed in NV SR No. 436/2008, which came into effect on December 29, 2009) represent the third group of these devices, for which the latest regulations and standards apply.

It is logical that the safety level of escalators and moving walkways decreases with the increasing age of these devices (Fig. 2). Escalators and moving walkways manufactured according to the latest regulations and standards therefore have the highest level of safety. However, this statement applies provided that the device is properly maintained (timely replacement of worn parts, adjustment and inspection of sensors and switches, etc.) and prescribed inspections and tests are carried out.

From a safety perspective, increased attention must be paid to escalators and moving walkways that were designed and manufactured according to STN standards in the last century (mentioned as the first group) and are more than 25 years old. For such devices, it is recommended to apply standard STN EN 115-2:2010 as soon as possible to increase their safety. Such devices may be in good technical condition and meet all requirements of regulations valid at the time of commissioning; however, residual risks are generated that are more numerous and serious compared to the latest escalators and moving walkways.

Eliminating or reducing residual risks is a fundamental task in terms of technical equipment safety. The use of escalators and moving walkways generates a relatively high number of potentially dangerous situations. The continuously increasing number of accidents when using escalators or moving walkways serves as proof.

The most common and serious hazards associated with the use of escalators and moving walkways for passengers include:

  • slipping or falling on steps/pallets/belts and entry/exit areas
  • falls caused by insufficient differentiation of step edges
  • entrapment between the balustrade skirt panel and the steps
  • entrapment between two steps or between two pallets
  • missing steps or pallets
  • impact between fixed and moving parts of the step/pallet/belt system
  • uncontrolled movement or failure of the drive machine’s emergency stop due to a missing second independent main contactor
  • excessive speed and unexpected change in drive direction
  • effect of excessive braking distance
  • fall caused by shortened braking distance
  • fall over the balustrade
  • fall caused by handrail speed deviation
  • finger shearing between the handrail and the balustrade
  • entrapment at the handrail entry into the balustrade
  • entrapment between the comb plate and the step/pallet
  • injury caused by an unsuitable or missing emergency stop switch
  • injury caused by body impact with building structural components (wall, ceiling, crossing structural parts)
  • missing means to prevent use for purposes other than passenger transport (e.g., for transporting shopping carts or luggage trolleys)

Increasing the Safety of Existing Escalators and Moving Walkways

As we have already mentioned, attention should be paid to increasing the safety of existing escalators and moving walkways. More than half of the escalators and moving walkways in Europe were installed in the last century. Therefore, standard STN EN 115-2:2010 was adopted, which establishes rules for improving the safety of existing escalators and moving walkways. Within Europe, it is the only technical document that addresses the issue of safety for older escalators and moving walkways. Based on risk assessment, this standard categorizes various risks and hazardous situations and also lists risks and corrective measures that can be gradually implemented.

Operation of active lightning conductors commissioned before 01. 03. 2017 and protection of buildings against the effects of atmospheric electricity after 01. 03. 2017.

The National Labour Inspectorate, based on the opinion of the Ministry of Labour, Social Affairs and Family of the Slovak Republic and responding to several inquiries from information seekers regarding compliance with legal and other regulations to ensure the safety of technical equipment under Act No. 124/2006 Coll. on Occupational Safety and Health and on amendments to certain acts as amended (hereinafter the “Act”) in connection with Decree of the Ministry of Labour, Social Affairs and Family of the Slovak Republic No. 508/2009 Coll., which establishes details for ensuring occupational safety and health when working with pressure, lifting, electrical, and gas technical equipment and which establishes technical equipment considered reserved technical equipment as amended (hereinafter “Decree No. 508/2009 Coll.”) following the withdrawal of STN 34 1398:2014 Protection against lightning. Active lightning conductors, has issued the following opinion:

Operation of active lightning conductors commissioned before 01. 03. 2017

For lightning protection systems constructed and commissioned during the validity of STN 34 1398:2014, an inspection technician may continue to verify the safety of the active lightning conductor through professional inspection and professional testing according to this STN. If the lightning protection system on the respective building complies with this standard, it may remain in operation. If, based on findings from inspection activities under Section 9 of the Act, the lightning protection system does not meet safety requirements, the employer is obliged to rectify the deficiencies identified by the inspection activity in the interest of ensuring occupational safety and health and to plan its reconstruction for the purpose of risk minimization. In the interest of ensuring occupational safety and health, the employer is obliged to eliminate hazards and threats, and if this is not possible according to achieved scientific and technical knowledge, to implement measures to limit them and prepare measures for their elimination (Section 6, Paragraph 1, Letter f) of the Act).

Commissioning of active lightning conductors for which project documentation was prepared and approved before 01. 03. 2017

If the project documentation for an active lightning conductor was prepared and approved before the withdrawal of standard STN 34 1398:2014 under Section 14, Paragraph 1, Letter d) of the Act, or if all active lightning conductors in progress classified as Group A reserved electrical technical equipment, whose technical documentation was assessed and a professional opinion on the documentation was issued under Section 5 of Decree No. 508/2009 Coll. by 01. 03. 2017, they may be completed according to this approved documentation. Before commissioning these devices, the official test and professional inspection and professional testing are performed according to the standard approved in the project documentation and according to which the device was installed, i.e., STN 34 1398:2014. Within the scope of the building occupancy permit process and its changes, the Labour Inspectorate will consider this as fulfillment of the requirements for ensuring occupational safety and health.

Protection of buildings against the effects of atmospheric electricity from 01. 03. 2017

Protection of buildings against the effects of atmospheric electricity is demonstrated by meeting the requirements specified in the STN EN 62 305 1 to 4 series.

According to Section 38, Paragraph 1 of the Act, if an employer or a natural person who is an entrepreneur and not an employer fulfills the obligations established by this Act and other generally binding legal regulations for ensuring occupational safety and health in a manner or procedure regulated by a Slovak technical standard, such fulfillment is considered fulfillment of the requirements for ensuring occupational safety and health; these obligations may also be fulfilled in another demonstrably appropriate manner.

It follows from the above that an employer or a natural person who is an entrepreneur and not an employer may also fulfill lightning protection requirements in another way after demonstrating compliance with safety requirements, which must not increase the risk level of the technical equipment above the risk levels defined in the technical standard.

Most Frequent Deficiencies Identified During Machine Assessment

Verification of compliance with machine safety requirements pursuant to Section 14, Paragraph 1, Letter d) of Act No. 124/2006 Coll.

  1. Machine identification is missing (manufacturer’s name and address, series or type designation, serial number, and year of manufacture).
  2. Insufficient lighting of workplaces and internal working areas of machinery corresponding to work operations (internal and external lighting of machinery).
  3. The control system is not safe and reliable enough to prevent hazardous situations.
  4. Machine control and monitoring elements are not clearly visible, identifiable, and appropriately marked, nor are they positioned to allow for guaranteed, error-free, quick, and unambiguous operation.
  5. The machinery can be started unintentionally. This unintentional start-up of machinery is also possible during restart after it has been stopped for any reason.
  6. Each workstation of the machinery is not equipped with a control device to stop certain or all moving parts of the machinery. The command to stop the machinery must override the commands to start the machine. After stopping the machinery or its dangerous parts, the power supply to the respective drive unit must be interrupted.
  7. The machinery is not equipped with an emergency stop device in justified cases.
  8. The machinery is not equipped with an operating mode selector (switch) that can be locked in any position.
  9. Due to its shape or specified installation (insufficient stability), the machinery lacks means for anchoring.
  10. Accessible parts of the machinery have sharp edges, sharp corners, and rough surfaces that could cause injury.
  11. Moving parts of the machinery create mechanical hazards – a risk of contact that could cause injury. The machinery is not equipped with guards or protective devices.
  12. The machinery is not equipped with appropriate fixed and/or movable (including adjustable) protective guards and/or other protective devices (e.g., light curtains and screens, footbridges, etc.) to protect against hazards from moving external parts (such as drive pulleys, belts, gears, etc.) or moving working parts in the working area. Protective devices are not adjustable only by deliberate manipulation (e.g., with a tool, key, etc.).
  13. The machinery has accessible surfaces (media lines) with high or very low temperatures, posing a risk of injury.
  14. The machinery poses a risk of fire or overheating (* or caused by gases, liquids, dust, vapors, or other substances generated or used in the machinery).
  15. The machinery exceeds the permissible noise emission.
  16. The laser equipment of the machinery has insufficient shielding against radiation generated by reflection or scattering, including secondary radiation.
  17. The machinery poses a hazard due to emissions of gases, vapors, liquids, or dust, etc. The equipment is not fitted with a suitable extraction or protective device located at the source of the hazard.
  18. Access to the operating position (stairs, ladders, work platforms, etc.) is not designed to prevent slipping, tripping, or falling on or from these parts.
  19. The machinery does not have safe access to all areas important for operation during work, adjustment, and maintenance.
  20. The machinery is not equipped with a means to disconnect from all energy sources – a central controller.
  21. The central controller is not clearly marked and lockable.
  22. The warning device does not meet the requirements of specific regulations concerning safety colors and signs.

Content of Project Documentation for Building Permit Proceedings

Technická inšpekcia, a.s. assesses whether technical equipment, materials, project documentation for buildings with technical equipment and its amendments, and documentation for technical equipment and technologies comply with occupational health and safety requirements.

Project documentation for a building (building project) submitted for building permit proceedings includes, depending on the type and purpose of the building, in particular:

  • an accompanying report with data supplementing the basic information about the building provided in the building permit application, with information on compliance with the conditions of the land-use decision, if issued, or compliance with the conditions of the approved zoning plan if a land-use decision is not required, and information on the results of surveys and measurements performed,
  • a summary technical report, which must clearly state:
    • the proposed urban, architectural, and structural-technical design of the building, its structural parts, and the use of suitable construction products in relation to meeting the basic requirements for buildings and compliance with general technical requirements for construction, including general technical requirements for buildings used by persons with reduced mobility,
    • fire safety solutions according to special regulations,
    • requirements for energy and water supply, wastewater drainage, transport (including parking), waste disposal, and the solution for connecting the building to existing utility networks and technical equipment,
    • data on above-ground and underground structures on the building plot (including utility networks and technical equipment) and on existing protection zones,
    • for buildings with operational, production, or technical equipment, data on this equipment, the storage concept, internal transport solutions, and areas for service, maintenance, and repairs, and requirements for trial operation after completion of the building,
    • data on compliance with conditions set by the relevant state administration authorities, if obtained before filing the application,
    • site layout and measures to ensure occupational health and safety if construction work is carried out under extraordinary conditions,
    • the method of ensuring occupational health and safety and the safety of technical equipment during construction as well as during future operation,
  • the overall site plan (layout plan) usually at a scale of 1:200 to 1:500, indicating:
    • property boundaries and their parcel numbers according to the real estate cadastre, including neighboring plots and existing structures on them,
    • underground utility networks and technical equipment,
    • proposed connections to the transport and technical infrastructure of the area,
    • protection zones;

in the case of a linear structure, a drawing of its route on a map base at a scale of 1:10,000 or 1:50,000; additional drawings according to the purpose and complexity of the structure,

  • staking-out drawings or necessary geometric parameters indicated in the layout plan for simple structures,
  • construction drawings of the building showing the current and proposed state, especially floor plans, sections, and elevations (usually at a scale of 1:100) containing individual types of structures and parts of the building (e.g., foundations, load-bearing structures, staircases, building envelope, roof structures, chimneys), the horizontal and vertical layout of the building and all its spaces with precise functional designation, schematic indication of internal distribution systems and installations (e.g., plumbing including fire water mains, high-voltage, low-voltage, gas, hot water), technical equipment (e.g., boiler rooms and elevators), and modifications and solutions prescribed for the special security of buildings in terms of civil protection, fire protection, and fulfillment of basic requirements for buildings,
  • a structural assessment of the building demonstrating the mechanical resistance and stability of the load-bearing structure,
  • a proposal for the landscaping of the building’s surroundings (exterior) and a proposal for the protection of greenery during construction,
  • in the case of buildings with operational, production, or technical equipment, construction drawings containing the spatial placement of machinery and equipment, including internal communication solutions,
  • in the case of buildings with special execution requirements, a construction organization project if the data provided in the summary technical report is insufficient.

If the developer applies for a building permit gradually for individual structures within a complex, the project documentation for the first structure includes the overall site plan (layout plan) of the entire complex, including the construction site facilities.

The overall site plan and construction drawings, especially floor plans, sections, and elevations, are submitted in a format that guarantees print durability.

For simple structures and temporary construction site facilities, the scope and content of the project documentation may be appropriately limited in individual cases after consultation with the building authority.

Commentary on Elevator Directive No. 2014/33/EU for Permanently Installed Elevators Used During Building Construction

According to Article 1(4) of the Elevator Directive, elevators are placed on the market when they are first made available to the user. The Elevator Directive does not distinguish between different categories of users. In some cases, elevators installed in new buildings are made accessible to construction workers to facilitate access to the building during its completion. In such instances, the elevator must be considered as “available to the user.” Therefore, this elevator must fully comply with the Elevator Directive, and the relevant conformity assessment procedures must be completed before construction workers begin using it for this purpose.

The commentary was prepared and approved by the members of the CEOC International CML (Machinery, Lifts, and Cranes) Technical Committee during their meeting in Budapest, Hungary 26. on February 27, 2007. This document was approved by the CEOC International Board of Directors in March 2007. The document was revised following further clarification by the European Commission – Directorate-General for Enterprise and Industry in 2011.

Under certain circumstances, elevators may be installed during building construction and used for transporting people and goods even before their official commissioning. Once construction is complete, these elevators must be properly commissioned and used as permanently installed elevators in accordance with the Elevator Directive.

During the period after elevator installation but before official commissioning, a conformity assessment of the installation with regard to the Elevator Directive must be carried out to ensure that the elevator’s safety features protect the end-user. This conformity assessment procedure should be documented to provide means (data) for demonstrating the permissibility of commissioning.

The CEOC Machinery and Lifts Commission also recommends, in accordance with the Use of Work Equipment Directive (89/655/ECC), that an initial inspection be performed by an authorized person before these elevators are put into limited operation for use by construction workers. This initial inspection will determine whether adequate and satisfactory safety measures have been implemented. Furthermore, if relevant to the building’s completion schedule, additional periodic inspections performed by an authorized person may be required in accordance with regulations to ensure the continued safe operation of these elevators. If these elevators are needed for temporary use by construction workers, then, to enable such use, protective measures must be adopted in accordance with the Elevator Directive, specifically:

  • the elevator must not be used before the initial assessment and certification of safety for temporary use.
  • use must be monitored by a person professionally qualified to operate the elevator.
  • a functional temporary communication tool must be available between the conveyance and workers on the construction site in case of emergency.
  • an accessible test report demonstrating sufficient function of safety devices.
  • a certificate stating the limitations of use and the period for such use.
  • appropriate and sufficient safeguarding to prevent access to mechanical and electrical hazards (acceptable standards, reference to EN 81 is required).
  • appropriate and sufficient lighting to ensure a safe working environment (acceptable standards, reference to EN 81 is required).
  • unobstructed access at the entrance to the unfinished elevator at landing level.
  • an appropriate maintenance regimen established to ensure the equipment remains in good condition.
  • regular inspections performed to ensure continued safe use.

National regulations on in-service elevator inspection may require an inspection of the elevator, which is used by construction workers for access and movement within the building during construction completion, before the completed building is handed over to the owner.

Do you know the safety level of older elevators?

What is the safety status of older elevators in apartment buildings?

This is a question surely asked by anyone living in an older apartment building with an elevator who is interested in addressing the quality of their living environment. When purchasing apartments into private ownership under Act No. 182/1993 Coll., many do not realize everything involved in ensuring that the elevator can serve them safely.

When making decisions, it is necessary to realize that an elevator is a technical device which, if it does not meet safety requirements, can cause injury, often fatal. For this reason, an elevator for the transport of persons and goods is considered a specified lifting device under Decree No. 508/2009 Coll., for which special rules apply regarding its design, manufacture, installation, reconstruction, repair, maintenance, operation, professional inspections, and professional testing.

Without regular inspection, preventive maintenance, and the timely elimination of identified deficiencies, it is impossible to ensure the smooth and safe operation of elevators.

In the Slovak Republic, under the aforementioned decree and related technical standards, a multi-stage system for inspecting elevators during their operation is required, as shown in the following table.

During repeated official tests, inspectors from Technická inšpekcia, a.s. perform measurements and checks according to established working procedures for:

In practice, a system is commonly established where an elevator service company ensures the performance of inspections, professional inspections, and professional tests based on a contract concluded with the elevator operator (apartment building manager).

Repeated official tests are somehow being forgotten. For comparison, it is similar to a car driving without a technical inspection—without an MOT. The purpose of repeated official tests is an impartial assessment of the elevator’s technical condition by an independent third party.

  • electrical properties (impedance, insulation resistance),
  • mechanical and other properties (permitted tolerances of machine and mechanical parts of the elevator, elevator speed and RPM, lighting intensity),
  • functional tests,
  • load tests,
  • tests of brakes, safety gears, and overspeed governors.

When such repeated official tests are performed, Technická inšpekcia a.s. inspectors find, for example:

  • non-functional elevator car safety gears,
  • worn suspension ropes and traction sheaves,
  • damaged and insufficient locking of landing doors,
  • insufficient mounting of the elevator car counterweight,
  • damaged shaft enclosures (glass panels),
  • damaged internal walls of the elevator shaft in elevators without car doors.

Experience and findings from the investigation of elevator accidents and injuries confirm that these specific deficiencies are the most common causes of tragic events.

The poor condition of elevators in apartment buildings is also significantly affected by persistent vandalism. Although apartments in the building are privately owned, the elevator is part of the common equipment. Some apartment owners still do not realize this fact and, through a reckless approach, are “taking money out of their own pockets.” Damage to the elevator is ultimately paid for from the operation, maintenance, and repair fund, to which even such unadaptable apartment owners must regularly contribute.

When assessing the technical condition of elevators in operation, the general principle is that devices are assessed according to the standards in force at the time they were put into operation. Simply put: “Old elevators are assessed according to old standards and new ones according to new standards.” Technical progress and development also affect the field of elevators. Elevators currently being supplied are at a higher safety level than elevators installed in the past. In the interest of objective information, it should be noted that in 2004, the STN EN 81-80 standard was published, which is not mandatory in the Slovak Republic and which adopts the requirements of the standard valid in the EU. This standard provides rules for increasing safety in existing elevators intended for the transport of persons or persons and goods.

The reasons why STN EN 81-80: 2004 was published are that:

  • the current situation of varying safety levels of elevators in Europe causes an increasing number of accidents. This level is influenced by several of the following facts:
  • there are usually no attendants (operators) in elevators,
  • many buildings do not have caretakers, which causes problems during the rapid rescue of persons trapped in the elevator,
  • most elevators are not adapted for persons with limited mobility and orientation,
  • more than 3 million elevators are used in European Union countries and 50% of them are more than 20 years old; the situation in the Slovak Republic is similar. These elevators were installed with a safety level corresponding to that time. However, this level was lower than the current one,
  • if older elevators are not updated to the current state of safety technology, the number of injuries may increase.

The purpose of the STN EN 81-80: 2004 standard is that it:

  • categorizes various hazards and hazardous situations, each of which is analyzed through a risk assessment,
  • provides corrective measures for gradual and selective improvement so that the safety of all elevators intended for the transport of persons or persons and goods reaches the current state of safety,
  • allows an analysis to be performed on every elevator and enables safety measures to be determined and gradually implemented, choosing the method based on the occurrence and severity of individual risks,
  • provides a list of high, medium, and low risks and corrective measures that can be gradually implemented to eliminate risks.

So, how to answer the question asked at the beginning?

First, it is necessary to objectively and impartially assess the technical condition of the elevator—to determine the “diagnosis and then start the treatment.” Inspectors from Technická inšpekcia a.s. are ready to assess the existing condition of the elevator; contact information for the relevant regional offices is available on the website www.tisr.sk. This is done by performing a repeated official test, after which they issue an expert opinion. Based on such an assessment, the elevator operator can then objectively decide which path to take: whether the elevator will be gradually modernized or whether they will decide to replace it with a new elevator.
