Children’s Playgrounds and Sports Recreation Facilities

Following the repeal of Act No. 371/2019 Coll. on playground safety requirements and the prior repeal of Government Ordinance No. 349/2010 Coll., playground equipment and other sports and recreational facilities are no longer considered “designated products.” Their safety is now governed solely by general product safety regulations, specifically the currently valid Act No. 83/2025 Coll. and the relevant Regulation (EU) 2023/988 of the European Parliament and of the Council.

These regulations define what constitutes a safe product and outline the obligations of various market entities (manufacturers, importers, distributors, authorized representatives) when placing products on the market.

In general, if a technical standard exists for a given product, it must be followed during manufacturing. Conformity assessment does not need to be verified by an independent third party, and the manufacturer declares compliance with the standard themselves. This means that so-called product certification is not required.

Technická inšpekcia, a.s. offers voluntary certification for playground equipment and other sports and recreational facilities, as well as inspections of such equipment, the obligation for which arises from technical standards.

This primarily includes playground equipment, permanently installed outdoor fitness equipment, multi-sport arenas, skate parks, parkour facilities, rope parks, climbing walls, bouldering walls, gymnastic equipment, and similar items.

All these facilities fall solely under Act No. 83/2025 Coll. on General Product Safety and the related Regulation (EU) 2023/988 of the European Parliament and of the Council on general product safety. Naturally, in connection with these regulations, the relevant technical standards applicable to the specific equipment are applied.

Act No. 83/2025 Coll. and Regulation (EU) 2023/988 of the European Parliament and of the Council require the manufacturer or supplier to declare the equipment’s conformity with the applicable technical standards in some form and to prepare instructions for use, inspection, and maintenance in the language of the country where the product is placed on the market. Following the repeal of Government Ordinance No. 349/2010 Coll., equipment certification is no longer mandatory.

Yes, the use of a technical standard, if one exists, is mandatory if the manufacturer wishes to demonstrate that their product is safe.

For equipment with a declared conformity to EN 1176 standards, annual main inspections are also mandatory. When a manufacturer declares compliance with EN 1176, this includes EN 1176-7, which is the operational standard prescribing the performance of inspections on playgrounds. Additionally, annual main inspections are mandatory for outdoor fitness and workout equipment according to EN 16630 and multi-sport arenas according to EN 15312.

It should be noted that the so-called post-installation inspection according to Clause 6.1a of EN 1176-7 is also mandatory.

According to technical standard EN 1176-7, these should be so-called “competent persons.” This means individuals who possess specific knowledge and expertise in the field, have undergone training, and know how to perform the inspections. Furthermore, post-installation inspections and annual main inspections should be carried out by persons independent of the specific playground, meaning they are not involved in its design, manufacture, or operation.
